Motion for New Trial - "I was too sleepy"

Apparently in Memphis during a multi-day murder trial, the judge ordered late hours--until 10:00 or so--partly due to the defendant's medical conditions and partly to relieve the sequestered jury from spending weeks away from home. The defendant was convicted, but the attorney has moved for a new trial: "The court constantly rushed defense counsel, who the court knew had little sleep on account of the hours that the court was keeping for no good reason." I hope there's more to the motion than that, because that is just embarrassing.
